O artigo pretende analisar e sugerir uma saída para o paradoxo democrático, o dilema moral constitutivo entre a soberania nacional do Estado democrático liberal e o reconhecimento dos direitos humanos dos estrangeiros, apontado por Donatella Di Cesare. Para isso, serão reconstruídos o referido paradoxo, a partir das críticas da autora a Michael Walzer e David Miller, e a solução apontada por ela, que envolve a superação da ordem estadocêntrica e a criação de uma comunidade política que não seja centrada na (...) identidade nacional. Em seguida, serão sucessivamente analisadas as posições de tais autores, mostrando-se que as críticas feitas por Di Cesare não correspondem aos trabalhos desenvolvidos por eles sobre comunidade política e identidade nacional. Por fim, será sugerido que há congruências entre esses três autores que poderiam ajudar na construção conceitual de um conceito de comunidade política capaz de oferecer uma direção inicial de saída do paradoxo democrático. As fraturas da sociedade salarial e o aumento da precariedade de vida levam diferentes setores a se engajarem em ações sociais. O artigo analisa o papel das corporações no enfrentamento dos problemas sociais a partir de um debate sobre o tipo de racionalidade subjacente ao modelo de desenvolvimento globalizado (pautado na razão indolente de Boaventura de Sousa Santos) e da análise da imbricação da economia na estrutura social (através da sociologia econômica). Os resultados demonstram que, apesar de alguns avanços historicamente (...) consolidados, práticas consideradas inovadoras por parte das corporações encontram substantivos desafios para ultrapassarem o nível da compensação, o que se relaciona com a permanência dos princípios da racionalidade mercantil. O estudo conclui que a genuína inovação social necessita considerar uma perspectiva de desenvolvimento e inovação baseada nas liberdades substantivas dos seres humanos. (shrink)

The article presents a dialogue, made over time, about the concept of time. Thus, it recovers Franklin Leopoldo e Silva's interpretation of time in Bergson's philosophy and puts this interpretation in relation to an interpretation of time in Leibniz inspired by Deleuze and Benjamin's readings of the seventeenth-century author. I use testimony as a philosophical category to narrate my dialogue with Franklin Leopoldo e Silva, which began in 1993.

Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

Conscious experiences in infants remain poorly understood. In this NeuroView, Passos-Ferreira discusses recent evidence for and against consciousness in newborn babies. She argues that the weight of evidence from neuroimaging and behavioral studies supports the thesis that newborn infants are conscious.

Our goal is to investigate the notion of self-agency in William James and Donald Winnicott. With James, we examine the descriptive element of what constitutes a self. With Winnicott, we explore his explanatory theory on self-emergence. Winnicott's perspective is presented here as the prehistory of the Jamesian self. James's conception of self is similar to the Winnicottian notion of an "integrated self", an embodied position that emerges from the organism's actions in the experiential field. The combination of the two approaches (...) leads to the idea that the self is a flux of identities emerging in interaction with others in the "transitional space" (an intermediate area of experience). Female sex steroids can affect the motor system, modulating motor cortex excitability as well as performance in dexterity and coordination tasks. However, it has not yet been explored whether FSS affects the cognitive components of motor behavior. Mu is a sensorimotor rhythm observed by electroencephalography in alpha and beta frequency bands in practices such as motor imagery and action observation. This rhythm represents a window for studying the activity of neural circuits involved in motor cognition. Herein we investigated whether the (...) alpha-mu and beta-mu power in the sensorimotor region and the alpha and beta power over frontal, parietal, and occipital regions are modulated differently in the menstrual, follicular, and luteal phases of menstrual cycles in right-handed dominant women. To do so, these women underwent MI and AO in the three menstrual cycle phases. The spectral activity of the cortical regions for the alpha and beta bands were compared between phases of the menstrual cycle and a correlation analysis was also performed in relation to estrogen and progesterone levels. For the hypothesis-based approach, beta-mu event-related desynchronization was significantly stronger in the C3 channel in the follicular phase than in the menstrual and luteal phases. For the data-driven approach, beta ERD during MI was higher in the follicular phase than in the menstrual and luteal phases in the frontal region. These findings suggest the effect of FSS on executive movement control. No effect of menstrual cycle phases was observed in cortical areas investigated during OA, but alpha and beta bands correlated positively with the follicular phase plasma estradiol level. Thus, the attenuation of alpha and beta bands referring to mirror neuron activities appears to be associated with inhibition of cortical activity when estradiol levels are lower, improving cognitive processing of motor action. Is the dream of EU endangered? This book reviews classic and modern values and virtues, and uses them in order to rethink Europe's present politics and its future. The idea of the Republic was born with the political ethics of ancient Greece. The current international crisis obliges Europe to face the mirror of truth: What has become of the European Idea and how fares the European Constitution? It has been a long road from the Greek Politeia to the present lack (...) of values and financial monomania in Europe, who seems to have lost any harmony between the spirit, the soul and the body of her Constitution: the will and values of the people (material constitution), the text of the Lisbon Treaty (formal constitution) and its current political interpretation and action (real constitution), making Europe a two-tier or three-tier club, far from the dream of the founding fathers. Without republican values and virtues, and failing to uphold the European social model, the European Union would devolve into moral, social and democratic bankruptcy. (shrink)

The formation of the education professional has been a top subject of studies during the history of education in Brazil and must be a human formation directly related to his or her emancipation as a social, individual person. This is his or her truth citizenship and sine qua non to the formation of a new man for the construction of a human culture. In this sense, the concept of man is the fundamental axis of formation of the education professional. Theoretical (...) matrices that have given rise to individualism and its powerful concepts are analyzed, as well as the new dominant ideas that, in an explicit or implicit way, construct in our society by different forms of social consciousness. There is a firm conviction that the understanding of man as alive, active, and conscious in material existence, according to concrete life, looks as the formation of consensus, organic emancipating scientific fundamental of radial change in social relations on a global society and with the possibility of human culture. I suggest here ecologies of the nascent state, posing the following general questions: what is this state and what is it to live, to fabricate modes of life, in its immanence? I believe populating this state is, by right, ‘ecological’, even if what I offer here is only a sketch or glimpse, playful as it is, of the possibility of such modes of life, of dwelling. As I develop it here, the nascent is in flight of being. It is populated (...) by lesser, minoritarian existences. If it is ‘ecological’, it is because these existences, or modes of becoming, are themselves, in their own right, ‘ecologies’, that is, modes of dwelling, of life, on the ‘other side of existence’, as Antonin Artaud put it once, in exile from Being. The power to return eternally to the nascent state is the power to live, to dwell, in the absolute forgetfulness of Being, in the interstice where philosophy supposedly ends, but where it nevertheless begins again, in oblivion itself, where being is never already the verticality of Being, its difference with beings, but always nascent, in the beginning, eternally so. Based on the readings of the philosophers Gilles Deleuze, Félix Guattari and Michel Onfray, the present article aims to carry out a critical assessment based on what is meant by “control society” and then, inspired by the Nietzschean philosophy of “Super human” [Übermensch], verify the feasibility of flourishing a human type whose creative and courageous posture surpasses the most adverse hypotheses of postmodernity. That said, the research adopts the following method: first, succinctly, to present the development of the different record (...) productions, as presented in The Anti-Oedipus; second, after the Deleuzian work opens up the scope for thinking about the “schizo”, that is, the individual below the social impositions, we complement with the hypothesis of the onfraryan typology of the “condottiere”, making it a model of resistance and insubmission, inspiring, therefore, the possible appearance of a fourth record production analyzed by Deleuze and Guattari. Associations between language and executive functions are well-established but previous work has often focused more on EFs than on language. To further clarify the language–EF relationship, we assessed several aspects of language and EFs in 431 Swedish children aged 4–6, including selective auditory attention which was measured in an event-related potential paradigm. We also investigated potential associations to age, socioeconomic status, bi-/multilingualism, sex and aspects of preschool attendance and quality. Language and EFs correlated weakly to moderately, indicating that relying on (...) measures of vocabulary alone may overestimate the strength of the language–EF relationship. Contrary to predictions, we found no correlations between selective attention and EFs. There were however correlations between morphosyntactic accuracy and selective auditory attention which is in line with previous work and suggests a specific link between morphosyntax and the ability to suppress irrelevant stimuli. In Sweden, socioeconomic differences are rather small and preschool is universally available, but nevertheless, aspects of parental SES predicted children’s performance on all measures. Bi-/multilingual children performed lower on language also when controlling for SES, highlighting the need for interventions to reduce inequalities in educational outcomes already in preschool. A female advantage was found for both language and EFs, whereas preschool attendance and quality were not significantly related to outcome measures. Future work should include longitudinal studies of language and EF development, include children from diverse SES backgrounds and contribute toward a theoretical framework that further clarifies the language–EF relationship. This paper contains a consideration of the notion of genius and its significance to the discussion of the aesthetics of sport. We argue that genius can make a positive aes- thetic contribution in both art and sport, just as some have argued that the moral content of a work of art can affect its aesthetic value. A genius is an exceptional inno- vator of successful strategies, where such originality adds aesthetic value. We argue that an original painting can have greater (...) aesthetic value than an exact replica, merely because it is the original. By parity of reasoning, a successful innovation in sport has additional aesthetic value just because it is a new creation. The genius is one who can provide this extra aesthetic pleasure and on that basis is rightly valued. The genius need not be conscious of how they achieve such innovations and thus find their own genius to be something they cannot explain but only demonstrate. In sport, innova- tions that offer new ways of playing or solving problems can produce competitive success which demands instant recognition and rewards. (shrink)

Palace of the End is a dense triptych of monologues exploring alternative narratives - albeit based in real facts - behind the events and the headlines surrounding the war in Iraq. Borrowing its title from the former royal palace where Saddam Hussein’s torture chamber was located, Thompson’s docudrama is structured as a chain of monologues telling three real-life stories set in the context of the war in Iraq. The play conveys three unconventional interpretations of the realities of war: that of (...) a young American soldier convicted for her misconduct at Abu Ghraib, the prison that stands as one of the most controversial symbols of the American-led Iraq invasion; a British scientist and weapons inspector who denounces what he understands as the false arguments given by his country’s leaders for engaging in a distant war; and an Iraqi mother whose life was shattered firstly by Saddam Hussein’s authoritarian regime, and later by the American first Gulf War. Each story is an enthralling and gut-wrenching reflection of one of the contemporary world’s most studied and controversial conflicts. The play gives voice to three different kinds of war victims, insofar as their political subjectivities and their moral conundrums are concerned. (shrink)

This book examines the significantly similar, yet finally different, thinking of two nineteenth-century existentialist thinkers, Soren Kierkegaard and Friedrich Nietzsche. Its focus is on the different ways each envisioned a joyful acceptance of life - a concern they shared. Each strove to give a place to this acceptance in his picture of life, but their conceptions of it are far apart.

The principal aim of the thesis is to develop a developmental account of conscious experience. In this account, the objective is to understand and explain the phenomenal experience of newborns and pre-linguistic infants. The question that guides the investigation concerns the phenomenality of babies' experiences: what is it like to be a baby? There are some crucial philosophical issues that any account of the nature of infant consciousness must face: the ontology of early conscious states; the epistemic status of infants' (...) experiences; the content of infants' experiences. The thesis addresses how we evolve as conscious beings from early states of life until we become full self-conscious beings who are morally responsible for our actions. The thesis involves four chapters. The first chapter explores phenomenal consciousness in newborns, first addressing the epistemological and methodological problems, and then arguing that newborns are phenomenally conscious and have a variety of phenomenal experiences. The second chapter addresses representation in newborns, claiming that their conscious experiences represent the world and discussing the consequences for representationalism. The third chapter focuses on the sense of agency, arguing that infants have a sense of agency and a sort of self-consciousness. The fourth chapter discusses moral agency, focusing mainly on the role of empathy. (shrink)

In view of Alexander of Aphrodisias’s and Porphyry’s respective positions on the issue, I discuss whether logos apophantikos is to be defined, as DI 4 seems to imply, by its being true or false or rather, as DI 5 seems to imply, by its representing the ontological combination/separation of substrate and attribute through the logical combination/separation of subject and predicate.

Scholars have long debated whether leader's integrity affects managerial decision making with respect to social responsibility. In this paper, we propose a model in which transformational leadership mediates integrity and corporate social responsibility and examine the relationship between these concepts. A survey of 170 senior managers from 50 organizations was conducted. Results indicate that integrity is a predictor of transformational leadership behavior and that transformational leaders’ behaviors are linked to CSR practices. It was also found that leaders rated with higher (...) integrity are engaged in CSR because they exhibit more transformational leadership behaviors. These findings add to the extant literature by demonstrating that integrity is important as transformational leaders engage more actively on ‘responsible’ behaviors. Practical implications call for an understanding among corporate leaders of the benefits of integrity and how it relates to transformational leadership. Organizations can improve their selection and leadership development processes by focusing on these two dimensions. (shrink)
